The booking disclaimers, licensing and practical terms that apply to every shoot.
Booking disclaimers
- All images captured during the session will be made available for download through the website TransferNow, with a link that is active for 356 days. I advise you to download them off TransferNow before the 356 day limit.
- All images will be provided without any watermarks.
- Feel free to use the images on your social media — just tag #thomas_brown_photography on your posts.
- I am based in Newport, Shropshire. Please do not confuse this with Newport, Wales.

1. Booking and confirmation
A booking is confirmed when you accept a written quote in writing, by email or through the enquiry form on this website. The quote states what is included, the number of edited images you will receive, the delivery date and the licence granted to you. Nothing is confirmed on a verbal agreement alone, which protects both of us.
2. Fees, deposits and payment
For commissioned and commercial work a deposit of 25% may be requested to secure the date, and is deducted from the final fee. The balance is payable within 14 days of delivery unless stated otherwise on the quote. Travel beyond a 45 mile radius of Newport, Shropshire is charged at 45p per mile and is always shown on the quote before you accept it.
3. Cancellation and postponement
You may cancel or postpone a booking at any time. If you cancel more than 14 days before the date, any deposit is refunded in full. Within 14 days, the deposit is retained to cover the date being held. Fixtures postponed for weather or for reasons outside anyone's control are rescheduled at no additional charge whenever my diary allows.
Drone bookings include a contingency date as standard, because aerial work cannot be flown safely or legally in high wind, heavy rain or poor visibility.
4. Copyright
Under the Copyright, Designs and Patents Act 1988, copyright in all photographs remains with Thomas Brown at all times. Commissioning a shoot does not transfer copyright. What you receive is a licence to use the images, as described in section 5.

5. Licence and permitted use
Unless your quote says otherwise, you receive a non-exclusive, perpetual licence to use the delivered images for the purposes agreed in the quote. In practice this normally covers:
- Club, business and personal social media accounts
- Your own website
- Printed programmes, posters and internal materials
- Press use where the club or business is the subject
The licence does not cover resale of the images, licensing them on to a third party, or use by a sponsor or commercial partner unless that has been agreed and priced. If a sponsor wants to use an image, ask — it is usually straightforward.
6. Credit
A credit is appreciated on every published use and required for press and editorial use. The format is Photograph: Thomas Brown / thomasbrowncreates.com. On social media, tagging #thomas_brown_photography is enough.
7. Editing and alterations
Images are delivered edited and colour-graded to a consistent standard. Please do not apply heavy filters, crop out the subject, or alter the images in a way that materially changes their content, as the work remains attributable to me. Simple cropping to fit a platform's aspect ratio is fine.
8. Delivery
Delivery is by TransferNow link, active for 356 days from the date of sending. You receive web-sized files for online use and full-resolution files for print in the same delivery. It is your responsibility to download and store the files within that window; once the link expires I cannot guarantee that the set can be recovered.
9. Selection of images
The selection of which frames are delivered is mine, based on technical and editorial judgement. Unselected frames are not supplied and are not available for review. If a specific shot was on the agreed shot list and is missing, tell me and I will look for it.
10. Children and safeguarding
Where a shoot involves anyone under 18, I work to the organisation's own safeguarding and photography consent policy and require the organiser's written permission before photographing. If a parent, guardian or the organisation asks for an image to be withheld or removed, I will do so without question. Please tell me about any consent restrictions before the shoot rather than after.
11. Access and conditions on the day
You are responsible for arranging my access to the venue, including any accreditation, parking and permission to stand pitch-side or rink-side. If access is refused or restricted on the day through no fault of mine, the fee remains payable.
12. Liability
I carry public liability insurance, and a certificate is available on request. In the unlikely event of equipment failure, illness or another circumstance that prevents delivery, my liability is limited to a full refund of fees paid. I cannot be held liable for indirect or consequential loss.
13. Complaints
If you are unhappy with any part of the work, email me within 14 days of delivery and set out what the problem is. Most things can be fixed, and I would far rather fix them than have you tell somebody else about it.
14. Governing law
These terms are governed by the law of England and Wales, and any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
